1. Acceptance of Terms

By accessing and using the website hosted at lifted-photo-video-b8f419.webflow.io (the "Site") and the services provided by Lifted Photo & Video ("we," "us," or "our"), you agree to comply with and be bound by the following terms and conditions. If you do not agree to these terms, please do not use our services or website.

2. Services Description

Lifted Photo & Video provides professional media services, including but not limited to architectural photography, drone aerial cinematography, 360° virtual tours, and video production. All services are subject to availability and scheduling.

3. Intellectual Property and Usage Rights

Unless otherwise agreed upon in writing, Lifted Photo & Video retains the copyright to all media (photos, videos, 3D models) produced. Clients are typically granted a non-exclusive, non-transferable license to use the media for the specific marketing purposes discussed (e.g., real estate listings, social media, or company websites). Redistribution or resale of the media to third parties without prior written consent is prohibited.

4. Booking and Cancellation

All appointments must be confirmed in advance. We understand that weather and scheduling conflicts occur, particularly for drone operations. Cancellations made less than 24 hours before a scheduled shoot may be subject to a cancellation fee. In the event of unsafe weather conditions (high winds, rain, or FAA flight restrictions), we reserve the right to reschedule the shoot at no additional cost to the client.

5. Payment Terms

Payment is due upon receipt of the invoice or as otherwise specified in the service agreement. We reserve the right to withhold the delivery of high-resolution, unwatermarked files until full payment has been received. Late payments may incur additional fees.

6. FAA Compliance and Safety

As a professional drone service provider, we operate under FAA Part 107 regulations. We reserve the right to refuse any flight operation that we deem unsafe or in violation of federal, state, or local laws. The pilot-in-command has final authority over all flight operations.

7. Client Responsibilities

The client is responsible for ensuring that the property or location is ready for photography at the scheduled time. This includes interior staging, exterior landscaping, and securing necessary permissions from property owners or managers for us to be on-site.

8. Limitation of Liability

Lifted Photo & Video shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services or the inability to complete a shoot due to circumstances beyond our control (e.g., equipment failure, weather, or restricted airspace).

9. Privacy Policy

Any personal information collected through our contact forms or booking process will be used solely for the purpose of providing our services and communicating with you. We do not sell or share your data with third parties for marketing purposes.

10. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the State of North Carolina.

11. Changes to Terms

We reserve the right to modify these terms at any time. Any changes will be effective immediately upon posting to the website. Your continued use of the site or our services following any changes constitutes your acceptance of the new terms.
